These Terms of Service (“Terms”) govern your use of services provided by Ace Swim Lessons through this website, aceswimlesson.com, including but not limited to swim instruction, club membership, events, and merchandise. By making a purchase or submitting payment, you agree to these Terms in full.

1. Acceptance of Terms
By enrolling in a class, purchasing a membership, or submitting payment through this website or any other official payment channel of Ace Swim Lessons, you confirm that you:
Are at least 18 years old (or have parental/guardian consent if under 18)
Have read, understood, and accepted these Terms
Authorize all charges to your selected payment method
If you do not agree with these Terms, do not complete the payment or use our services.

2. All Sales Are Final – No Refunds
All sales are final. We do not offer refunds, credits, transfers, or rescheduling once a payment is made.
This applies to:
Swim class registrations
Membership fees
Private lessons
Merchandise
Missed sessions (regardless of reason)
No-shows or late arrivals
Chargebacks will be disputed. All transactions are documented and monitored. Filing a false chargeback may be considered fraud and pursued legally.

3. Payment Authorization
By submitting payment, you authorize Ace Swim Lessons to charge the full amount indicated to your provided payment method. You agree that:
You are an authorized user of the card or account used.
You will not attempt to reverse or dispute the charge without cause.
You understand this payment is non-refundable, non-transferable, and final.

4. Scheduling, Cancellations, and Service Interruptions
Ace Swim Lessons reserves the right to modify, reschedule, or cancel lessons or classes due to circumstances beyond our control, including but not limited to:
Weather conditions
Pool closures or maintenance
Instructor illness or unavailability
Safety concerns
Facility or operational issues
If a scheduled lesson cannot be performed due to such circumstances, Ace Swim Lessons will make a reasonable effort to reschedule the lesson or provide a make-up session at no additional cost.
If rescheduling or a make-up session is not reasonably possible, the customer may request a refund for the unused portion of the affected lesson(s). Refund eligibility under this section applies only when services cannot be provided due to circumstances outside the customer’s control.
Client-requested cancellations, schedule changes, missed sessions, no-shows, or late arrivals remain non-refundable and non-transferable.

5. Assumption of Risk and Liability Waiver
Participation in swimming activities involves inherent risks. By enrolling or submitting payment, you acknowledge and assume all risks associated with:
Water-based activities
Physical exertion
Potential injury or illness
You agree to release, waive, and hold harmless Ace Swim Lessons, its instructors, affiliates, and staff from any and all liability for injury, loss, or damages incurred while participating in any activity, whether on or off property.

6. No Guarantee of Outcomes
We do our best to provide high-quality swim instruction tailored to all ages and skill levels. However, we make no guarantees of skill progression, performance, or specific results. Success is dependent on individual effort, consistency, and other factors.

7. Conduct Policy
We reserve the right to remove any participant or parent/guardian from a class or event for behavior deemed disruptive, unsafe, or inappropriate — including harassment, foul language, or failure to follow safety rules. No refund will be issued in such cases.

8. Privacy and Data Usage
Your personal information will be handled in accordance with our Privacy Policy. We do not sell your information and take security seriously when handling your data.

9. Dispute Resolution
Any disputes shall first be attempted to be resolved through direct communication. If unresolved, all legal claims shall be subject to the jurisdiction of Riverside County, California, and governed by the laws of the State of California.
